"Kenton County prosecutors are asking a judge to confiscate the guns of a Fort Wright man charged with fatally shooting a dog in his neighborhood.
Kenton District Judge Ann Ruttle has scheduled a hearing today on the motion by Assistant County Attorney Ken Easterling, which asks the court to hold the guns until the case is resolved.
"This is at the request of every neighbor," Easterling said. "I have some serious concerns about the erratic behavior of the defendant, expressed by neighbors in the community."
Michael Marino, 46, is charged with misdemeanor counts of wanton endangerment and firing a gun inside city limits. Police said that on April 1, Marino shot and killed a dog with a .45-caliber pistol in the front yard of his Pickett Court home.
"The defendant has a history of not liking dogs and has pulled a firearm out before on dogs in the neighborhood," said the police report.
"Defendant admitted to shooting the dog in a residential area. Witnesses indicated dog was not threatening."
Marino told police he shot the boxer because the dog was chasing his children.
His attorney, Craig Kendrick, said his client, who has a concealed carry permit, has a constitutional right to own and carry a gun. Kendrick objected during a hearing Thursday to Easterling's request for a confiscation order for Marino's guns.
Easterling said Marino's Second Amendment rights are not absolute. The safety of the community is paramount, he said."-
Well okay, Mr. I-Protect-The-Community; why was a dangerous dog allowed to attack this mans children, and since it's your job to prevent such things how's a'come YOU are not up on charges for dereliction of duty?
Because your gun-grabbing doublespeak makes not a lick of sense, and I guess this is all we can EXPECT from the rathole that is Ohio.
The man was protecting his family, on his property, and this is a bad thing.
Horrid creatures these prosecutors but remember that without the strongarm thugs to enforce their edicts they'd be powerless.
